Transparent and removable glazing, the installation could become free construction

09/09/2022 – The creation and installation of removable and transparent panoramic windows could become a free building intervention.

To ask is an amendment to bill for the conversion of “Aid-bis” Decreeproposed by a group of Senators of the United Group for the CAL Constitution (Constitution, Environment, Work) – Alternative – PC – Ancora Italia – SMART Project – IdV

Transparent and removable windows, classification as free building requested

The amendment (33.0.6a) proposes to include, among the free building interventions, “the construction and installation interventions of removable and totally transparent panoramic windowsso-called VEPA, aimed at carrying out temporary functions of protection from atmospheric agents, improvement of acoustic and energy performance, reduction of heat loss, partial waterproofing of rainwater, balconies projecting from the body of the building or loggias falling inside the ‘building”.

The amendment provides for conditions so that the interventions qualify as free building: with the intervention, it is not necessary to create permanently closed spaces that can generate new volumes and change the destination of the balcony from an accessory surface to a useful surface.

Free building, interventions

If the proposal were to be approved, the construction and installation of the removable and transparent panoramic windows would be added to the list of free building interventions contained in article 6, paragraph 1, of the Consolidated Building Act (Dpr 380/2001).

The list of free building interventions currently includes: ordinary maintenance interventions, the installation of pumps up to 12 Kw, the elimination of architectural barriers without works that alter the shape of the building, temporary works by activity research in the subsoil, seasonal mobile greenhouses, seasonal works intended to be removed within 180 days, paving and finishing works of outdoor spaces, the installation of photovoltaic solar panels on buildings, with the exception of historic centers , the non-profit play areas and the furnishing elements of the appurtenant areas of the buildings.

The types of interventions that can be carried out without permission are explained in the Glossary of free building works.

Inserting in the list the installation of removable and transparent panoramic windows, which do not create new volumes, would reduce the disputes that often arise because these interventions cannot be correctly classified.

Very often, in fact, it is jurisprudence that determines which aspects to consider in order to understand how do you classify a balcony closing intervention and which qualification to use.
