Brno – The public prosecutor proposed to the court in Brno today to reject the request for the conditional release of the former CSSD governor David Rath, for three reasons. Among other things, because he did not pay the entire fine. Rath is serving a seven-year sentence for corruption, with half his sentence behind him. Rath’s lawyer, Roman Jelínek, proposed parole.

It is not clear whether the court will decide today and, if so, whether the decision will be final. If he makes a final decision on parole, Rath should be released from prison within a few hours. The former governor of Central Bohemia said in court today that he had learned that 3.5 years in prison was a sufficient experience. .

According to the Public Prosecutor, Rath’s self-reflection was not such as to make him aware of what he had done and how it had affected his view of politicians. She reminded that he also did not pay a fine. According to her, the conditional release of Rath would also be premature, because his sentence in the related case was illegally increased by one year.

In his final draft, Rath said that the later he got out, the worse his position would be when paying the fine. According to him, the public prosecutor’s office is taking revenge on him. He said he had met the conditions for improvement, which had been confirmed by two prisons.

The court in Brno is discussing a motion for the conditional release of David Rath

The Municipal Court in Brno is today hearing a request for the conditional release of the former Central Bohemian governor on behalf of the CSSD, David Rath. He is serving a seven-year sentence for corruption, with half his sentence behind him. Rath said he had learned and that 3.5 years in prison was a sufficient experience. It is not clear whether the court will decide today and, if so, whether the decision will be final. If he makes a final decision on parole, Rath should be released from prison within a few hours.

“I have half the sentence, 3.5 years, subjectively I think it was enough for me to realize that we need to live properly. It was enough experience for me to do something similar in the years to come and for the rest of my life. he didn’t, “Rath said. According to him, in his case it was a concurrence of many circumstances. “I’m sorry, I was aware of the mistakes, there was a whole chain of them. I deduced from this the findings for the possible next, when I don’t want the possible next in this area to occur at all,” Rath said.

He said he tried to do his best in prison, he has five commendations from prison. He now works as a doctor in the Brno remand prison. In the event of his release, he would work as a doctor at a polyclinic in Hostivice near Prague, but he would commute to work in the Brno remand prison two days a week, from which he allegedly received such an offer.

The proposal was not submitted by Rath’s lawyer, but by the Association of Patients of the Czech Republic, so the president of the organization, Luboš Olejár, acts as a witness. The organization wants to provide a guarantee for Rath. Olejár said that the organization had been cooperating with Rath since 2005, when he consulted with him on medical matters. He added that Rath gave consultations free of charge, there could be 50 to 70 of them a year. According to Olejár, there were two reasons why the union submitted the proposal. He wants to join the association again and wants Rath’s children to have a dad at home.

Ratha was detained by police in May 2012 with a bribe of seven million in a wine box. The Prague High Court later acknowledged Rath’s guilt in cases of influencing tenders for the reconstruction of Buštěhrad Castle in the Kladno region and the grammar school building in Hostivice near Prague. In this so-called first branch of the case, Rath interrogated a seven-year prison sentence and received a ten-million fine and a ban on operating, in order to gain an advantage in the award of a public contract and damage the EU’s financial interests. So far, he has paid about half of the amount. Given that the court could impose a surrogate sentence of 2.5 years, in real terms Rath would face about a year and a quarter of imprisonment for not paying half the amount. Rath said that if released, he could pay the fine better, up to 60,000 crowns a month.

In the second branch of the case, the Regional Court in Prague illegally extended Rath’s sentence for another year. According to the senate, another eight defendants and nine companies, including the construction company Metrostav, also committed crimes related to medical contracts in the region. The second branch will only be dealt with by the High Court of Appeal.
