The games of the Minister of Justice in the Marinaki case

Reportage: Vassilis Tzimtsos

Various questions are being raised about the stance of the Minister of Justice Costas Tsiaras, as for months the Government Gazette did not promote the transfer of the Piraeus Corruption Investigator Ioannis Petropoulos who had handled the controversial case concerning the shipowner Vangelis Marinakis for the transfer of 3 heroin with the ship “Noor 1”.

The President of the Court of First Instance, I. Petropoulos, had submitted a relevant request, which had been approved since November 2020 by the Supreme Judicial Council of the Supreme Court, in order to be transferred from Piraeus to the Athens Court of First Instance.

The transfer was then ordered after the completion of the investigation he was conducting for the much-praised case concerning the senders, recipients and financiers of the “white death” cargo.

The interrogation was completed last January, when Mr. Petropoulos decided to close the case with “formal calls” for Vangelis Marinakis and his associates, for the remittances totaling 4,000,000 euros from their interest companies and MCMP IL Maritime Capital Illinois-based Management Partners LLC that ended up in G Tankers, later sentenced to 18 years in prison for transporting drugs with “Noor 1”, Efthimiou Giannousakis.

Once he had completed the investigation for V. Marinakis and the other defendants, he could be transferred based on the relevant decision of the Supreme Judicial Council. In fact, there was no other pending case in the office of the Piraeus Corruption Investigator. Although Mr. Petropoulos had no pending case, he was not transferred to the Athens Court of First Instance, as decided by the Supreme Court.

Moreover, last June, the Supreme Judicial Council of the Supreme Court of the country accepted his initial request to be transferred to the Court of First Instance of Chalkida.

And yet for eight months no transfer took place.

Did not some officials of the Ministry of Justice go to the “paper” of the transfer to the minister Costas Tsiaras to sign the Government Gazette, or did the transfer “stumble” in the ministerial office?

In any case, the decision of the Supreme Court was not implemented immediately …

It should be noted that at that time there were relevant publications with reasonable questions and queries about the expediency of non-implementation of the transfer of Mr. Petropoulos by the Ministry of Justice.

But “no one sweated”…

Since then, circles have pointed out that some people may have wanted Mr. Petropoulos to stay in Piraeus until they are sure that the Marinaki case will go to the archives.

You can see the case file concerning Vangelis Marinakis and his associates, had been forwarded to the Piraeus Appellate Prosecutor Odysseas Tsorbatzoglou who finally decided in early June that the case file should not go to the archive, but for additional interrogation.

In fact, he asks for the assistance of the Financial Police and the American Homeland Security service, which had already provided the Investigator with financial information for millions of euros that ended up in the later convicted for the transport of heroin, Euth. Giannousaki.

Thus, the case was returned to Mr. Petropoulos and not to another investigator who would have been appointed if his transfer to Athens or Chalkida had taken place …

Mr. Petropoulos, who remained in the position of Piraeus Corruption Investigator (although he had to be transferred to the Athens Court of First Instance), would now have to challenge himself and his judgment that the case file should go to the archives.

Either he would carry out the investigative actions requested by Mr. Tsorbatzoglou (s.s. having essentially admitted that he had done an incomplete investigation by sending the case file to the file), or he would disagree with the Prosecutor and insist that the case file should go to the file. .

Having already decided that the case should go to the archive, his disagreement with the Prosecutor was essentially a “one-way street”.

The result;

The much-praised case concerning V. Marinakis and his associates remains meteoric in the Piraeus Council of Criminal Procedure, which will judge the dispute between the Investigator and the Prosecutor and will decide whether an additional interrogation will be ordered or will be taken to the archive.

All this for a case filed in March 2018 by the then head of the Piraeus Court of First Instance, Irini Tziva, who had filed serious criminal charges against the well-known shipowner, owner of the media and Olympiakos, while two more have changed.

Investigator Evangelia Afuxenidou was transferred to Athens a few months after she took over the case and her later colleague Kalliopi Mandaka resigned from the judiciary and immigrated to the USA, while Mr. Petropoulos had asked to be excluded from the case, because his father had served sports prosecutor for 3.5 years, by decision of the Board of the EPO, at a time when the dominant “player” of Greek football was Vangelis Marinakis’ Olympiacos.

It is recalled that former commanders of the EPO and V. Marinakis had recently sat in the chair of the accused for the much-praised case of the “set up” football matches, but were acquitted.

In Syros, at his request, the Prosecutor of Tsorbatzoglou Street

In contrast to Mr. Petropoulos, who has not received the “paper” of his transfer for the past eight months, initially in Athens and now in Chalkida, the road to Syros has already been taken by the Appellate Prosecutor Odysseas Tsorbatzoglou who handled the case against of V. Marinakis and his associates, judging that an additional interrogation should be carried out.

As “Jungle” revealed, Mr. Tsorbatzoglou took the “paper” of his transfer to Syros last Friday as head of the Aegean Appellate Prosecutor’s Office.

He was placed in Syros after being promoted from Deputy Prosecutor to Prosecutor of Appeals and following his own request which was accepted by the Supreme Judicial Council of the Supreme Court.

It should be noted that the Greek Supreme Court had unanimously selected him for the position of European Prosecutor in Greece, but it was not implemented after a “blockade” of the bodies of the European institution.

Thus, a few hours after his rejection for the position in the European Public Prosecutor’s Office, he was transferred to Syros, as was also his wish.
