The court dismisses the first lawsuit for “compulsory vaccination”

On Saturday, November 13, the Administrative District Court rejected a petition from private individuals to cancel sub-clause 5.3 of the Cabinet of Ministers Rules “On declaring an emergency”, which provides for the introduction of vaccination obligations for certain professions, the court said.

The Administrative District Court ruled that the obligation to vaccinate, if not complied with, limits the right of individuals to privacy and the right to freely choose an occupation and work in accordance with their abilities and qualifications.

After examining the circumstances of the case, the court concluded that the obligation to vaccinate, provided for by a state decree, is established in accordance with the law and pursues a legitimate goal – an urgent social need to protect the rights of others and protect the epidemiological safety of society, which is associated with limiting the spread of infection while ensuring the continuity of important public functions and services are in the public interest and is proportionate, i.e. the means used by the legislator are appropriate and necessary to achieve a legitimate aim and cannot be achieved by other restrictive measures.

The decision can be appealed to the District Administrative Court within one month from the date of the decision.
