The anomaly of public money and segregation by sex in school

Untying gender segregation in classrooms in the public education system is a goal shared by a large majority of both the educational community and Parliament, which is ultimately where the representation of Catalan society resides. In fact, on numerous occasions the chamber has urged the government to eliminate the economic agreement with those schools that separate boys and girls. Amb tot, l’executiu català no ha trobat complicitat en l’àmbit judicial, que equival a dir que no ha trobat empara en la legislació espanyola. The Minister of Education, Josep Gonzàlez-Cambray, announced yesterday a new attack by the Government in this line, and once again it is time to wait for the executive to emerge victorious.

It must be said that this onslaught is partial. The concerts have a different calendar: the primary one was renewed in 2021, and the infant, secondary and high school ones – renewed when 155 was in force – would end in 2022. Cambray’s predecessor in office, Josep Bargalló , captained the attempt with the primary and announced the elimination of the concert in 11 centers in May 2020. The TSJC, however, overturned that November in application of the then in force Lomce, the so-called Wert law, citing economic and pedagogical reasons. The resolution required the government to hold the concert for at least another six years. The executive filed an appeal still pending, which is why the primary is not part of Gonzàlez-Cambray’s announcement, which is limited to children, secondary and high school.

The new state education law, the Lomloe, was finally passed in December last year and came into force in early 2021. And the government has seen a new opportunity. Interpretable, if desired. Additional provision 25 states that public and subsidized schools “will develop the principle of co-education at all stages of education”. The department sees enough legal coverage to announce again to the 11 centers on the list that the concert will not renew them. But it is true that the wording of the additional 25 may not end up being conclusive enough in the face of judicial assessment.

In any case, it will be up to justice to determine how the Government should proceed. But whatever the sentence, in the middle of the 21st century it is absolutely defensible that public funds should not sustain education systems that do not precisely help to fight sexism, to overcome girl-girl stereotypes, to encourage cooperation from very small and to build a fully egalitarian society. In short, an anomaly. In many of these centers, segregation was also applied among teachers. Boys who didn’t know what it was like to take classes with a teacher, and girls with a teacher. Only the pressure of the administration, and through labor, managed to break it. Its existence is not now in question, as it depends on supply and demand, but it makes no sense for a model that goes so far against the public education system to receive money.
