Ayer Keroh: Husband and wife were charged in court here today for abusing and causing the death of a seven-year-old boy at a house in Taman Krubong Jaya, two weeks ago.
The accused, Mohd Fadzli Abdull Razak, 38, and Zuraida Atan, 32, who are also the victim’s stepfather and biological mother, were charged in two separate courts.
For the first charge in the Magistrate’s Court here, the accused was charged with causing the death of a boy at 3.32 pm on January 29 at his house in Taman Krubong Jaya, Melaka Tengah.
They were charged under Section 302 of the Penal Code which was read together with Section 34 of the same code and convicted, providing for the death penalty.
No confession was recorded from the two accused as soon as the charge sheet was read before Magistrate Mazana Sinin.
The husband and wife were also arraigned in Sessions Court here on charges of abusing the victim in the same way that may have caused him physical injury.
The incident was reported to have occurred between 10.30 pm on October 13 last year until 3.32 pm on January 29 at the same location.
The charge was made in accordance with Section 31 (1) (a) of the Child Offenses Act 2001 which provides for imprisonment for up to 20 years or a maximum fine of RM20,000 or both.
However, they pleaded not guilty to the charge as soon as the charge sheet was read separately before Judge Nariman Badruddin.
Nariman, however, did not allow any bail and both cases will be mentioned again on March 29 while waiting for the autopsy report.
The prosecution was conducted by the State Director of Prosecution, Badius Zaman Ahmad while the male accused was represented by lawyers Datuk Ahmad Musthafi Mohamad and Muhammad Firdaus Abd Razak.
The female accused was represented by Zamri Idrus, Ishak Mohd Kari, Yusman Che Aman and Saifuzzaman Ab Rahman.
On January 29, the boy was found dead in a water tank in Taman Krubong Jaya.
