Sismabonus 110% in the historic center, the chaos of the unitary project


25/06/2021 – Is it possible to carry out anti-seismic works facilitated with the 110% Sismabonus in historic centers? The answer is yes, but there are conditions to be respected, first of all that of drafting a unitary project.

But what is meant by a unitary project? According to the Revenue Agency, this means considering the aggregate of buildings. For Italian Seismic Engineering (ISI) it instead means thinking about the concept of structural unity.

It was there that triggered these doubts response to a questioning provided by the Regional Directorate of Emilia Romagna, which denied the concession for the anti-seismic works carried out on a building located in the historic center of Ravenna. To see clearly, we asked Andrea Barocci, president of ISI for explanations which, on the basis of the technical regulations, arrived at an opposite conclusion.

Sismabonus 110% in historic centers, the case of Emilia Romagna

The question was raised by the owner of a building in the historic center, consisting of a house in cadastral category A / 2 and a garage in category C / 6, with two side facades adhering to other existing buildings. The owner intends to carry out static consolidation and seismic improvement works extended to all structural parts of the building.

Despite the adhering walls, the owner points out that the building coincides with aindependent structural unit pursuant to Technical Construction Standards – NTC 2018 and of Circular 617/2009 (later replaced by Circular 7/2019). There are also no connections between the load-bearing structures of the building and those of the adjacent buildings. As this is a functionally independent property with an independent entrance, the owner believes he can take advantage of the discount.

The Revenue Agency stated that, based on the Guidelines for the classification of seismic risk (DM 28 February 2017), for the application of the Super sismabonus it is necessary to refer to the clearly identifiable structural unit according to the NTC 2018. However, this provision coexists with article 16-bis of the Tuir (Presidential Decree 917/1986), i.e. the rule that first introduced these deductions.

The Tuir establishes that “the interventions relating to the adoption of anti-seismic measures and the execution of works for the static safety must be carried out on the structural parts of buildings or complexes of buildings structurally connected and include entire buildings and, where they concern the centers historical, must be carried out on the basis of unitary projects and not on individual real estate units “.

This led the Agency to deny the facility despite the fact that the building involved in the works constitutes a structural unit.

According to the president of ISI, Andrea Barocci, it is necessary to refer to the technical regulations because the Tuir dates back to 1986, when the concept of structural unity linked to the aggregate of buildings.

Barocci believes that operating with a unitary project it means acting on the structural unity. An aggregate of buildings can also be composed of several independent structural units and in this case it would not make sense to involve the neighboring buildings in the anti-seismic intervention.

According to Barocci, an intervention carried out on a structural unit represents a total intervention, which should be able to obtain the Sismabonus 110%.

Sismabonus and historical centers, another case in Sicily

A similar problem was reported to us by a professional firm in Sicily. In this case, however, the Agency seems more inclined to recognize the deduction in the presence of a structural unit.

The professionals intend to carry out repairs or premises on a “tower” masonry real estate unit, located in the historic center, consisting of ground floor, first and second floor and bordering, both laterally and in the rear part, with other buildings of the same typology, belonging to different owners. The building, despite having its own structural system and an independent entrance, is connected with the buildings with which it borders and its supporting structures are placed side by side in absence of technical joint to the structures of the neighboring buildings.

The Regional Directorate of Sicily stated that, in order to obtain the 110% Sismabonus, interventions in historic centers must be carried out on the basis of a unitary project and not on individual real estate units, without distinguishing between structurally connected and non-connected buildings.

As explained by the Agency, the Commission for monitoring the guidelines for the classification of seismic risk in buildings has clarified that for the application of the sismabonus or the Supersismabonus, more than the functionally independent unit, it is necessary to refer to thestructural unit which, according to the NTC 2018, “must have continuity from heaven to earth, as regards the flow of vertical loads and, as a rule, will be bounded either by open spaces or by structural joints or by structurally contiguous buildings, but at least typologically different.

The Agency underlined that the qualification of the housing unit as a structural unit is beyond its competence, but concluded, based on the proposed reconstruction, that it is in the presence of buildings structurally connected to each other, thus denying the facility.
