Safety on construction sites, the Mims calls the contracting authorities

07/01/2022 – The Ministry of Sustainable Infrastructure and Mobility (MIMS) calls the contracting authorities involved in carrying out infrastructural works, including those envisaged by the National Recovery and Resilience Plan (PNRR), to enforce, in the formulation of tender, the rules and protocols for the protection of work and safety on construction sites.

And it does so with a Address Deed on the application of the subcontracting regulations signed on Tuesday by Minister Enrico Giovannini.

The new subcontracting discipline, which aligns the national legal system with the indications deriving from the Community institutions – recalls Mims -, intervenes with provisions to pursue the objectives of protection and safety in the workplace. These rules, assuming that the use of subcontracting determines the presence of a chain of companies for the construction of a work, ensure that the same levels of protection that the contracting authority requires from the contractor, are also guaranteed to subcontractors.

According to the Guidance Act, the contracting stations belonging to Mims must specify in the tender documents that compliance with the legislation on the protection of work and safety on construction sites is a essential condition for the execution of the contract and verify, during the execution of the contract, the application of the related rules of the Code of public contracts.

The contracting authorities, before authorizing the use of subcontracting for the execution of the works, must also verify compliance with the legislation on equal economic and regulatory treatment and the application of the related Collective Agreements. At the end of the first half of 2022, the contracting authorities will have to send the Minister a report on the actions taken to comply with the Guidance Act.

One I invite you to take similar initiatives it will be sent by the Minister to the Presidents of the Region, to the ANCI, to the Presidents of the Port System Authorities, to the Extraordinary Commissioners appointed in 2021, as well as to the Ferrovie dello Stato group, given that RFI and ANAS are important implementing bodies of the PNRR.

“The deadlines for implementing the PNRR are very stringent and a great effort is needed by all components of the company, especially those who work on construction sites”, says the Minister Giovannini. “The speed of execution must in no way jeopardize the protection of workers’ rights and their safety. With this act, the first of 2022, I would like to emphasize that among the priorities of the Government there is precisely the commitment to the protection of those who build, control and protect the infrastructures that contribute to building a better, stronger and more resilient Italy ” .
