‘Long live life’ lawsuit filed against Izmir Bar Association

Ali Erbaş, President of Religious Affairs, said in 2020, “Islam considers adultery one of the greatest harams. He condemns luthism and homosexuality”. Izmir Bar Association criticized Erbaş and made the following statement with the headline “Despite hate, long live life”:

“Hate speeches basically aim to eliminate human rights and freedoms and historical gains. What really needs to be fought is this discriminatory and hateful understanding. It is necessary to impose sanctions against hate speech and to prevent these expressions. Discrimination based on sexual orientation is as serious a problem as discrimination based on race, color and origin. We condemn the President of Religious Affairs for his discriminatory and hate speech speech.”

Following the announcement, an investigation was launched by the Karşıyaka Chief Public Prosecutor’s Office against the İzmir Bar Association President Özkan Yücel and the members of the Bar Association’s Board of Directors. Upon the investigation, Yücel and the members of the board of directors refused to make a defense, and the prosecution was not allowed as there was not sufficient evidence that a crime had been committed against the lawyers named in the report.

Despite the court’s decision not to prosecute, Karşıyaka Chief Public Prosecutor’s Office prepared an indictment against Yücel, the President of İzmir Bar Association, and 10 members of the board of directors.

In the indictment, the lawyers who did not defend despite the notifications made “Outically insulting the religious values adopted by a section of the public” It was demanded that he be tried in İzmir Heavy Penal Court on the charge.
