The Central Civil Court of Lisbon will judge a class action brought by a European consumer association against theFiat, Alfa Romeo and Jeep car manufacturers. According to “Jornal de Notícias”, at issue are the damage caused by the alleged installation of a mechanism that hides the emission of gases above the legal limit.
If the popular action is successful, the three brands may have to pay compensation to thousands of consumers in Portugal: the association asks for at least a compensation of 2600 euros per car. In the order, dated September 17, the judge says that, in light of the “very broad initial assessment”, the dismissal of the action is “manifestly challengeable”, and should therefore proceed to judgment.
The author of the action is Ius Omnibus, a non-profit association, created in March 2020 with the objective of defending consumers in the European Union, and which is chaired by Sandra Passinhas, professor at the Faculty of Law of Coimbra. Ius Omnibus estimates that the damages amount to 79 million euro and that at least 29,340 vehicles are involved.
Specifically, the action refers to “consumers of Fiat, Alfa Romeo and Jeep light vehicles with Euro 5 and Euro 6 FCA diesel engines (up to Euro 6c), sold or imported in Portugal and registered in the country from January 1, 2009 ”.
