In the program Prostor X, professor and constitutional lawyer Jan Kysela answered questions about the current state of emergency in the Czech Republic. In his opinion, the currently declared state of emergency is unconstitutional and, worse, people don’t care. The government allegedly aroused in people the feeling that they needed an emergency to survive, so the question of its legitimacy is being pushed to the other side.
“Many of us don’t care if we break or don’t break any legal rules, so we don’t really care if the government or the president or anyone else breaks any rules of law. And at a time when those in power and I understand the rules as too restrictive… But the purpose of those rules is to limit them, because if there are no rules, then we do not have to wait for those holders of that power to want from that to leave voluntarily, and at that moment I think we would have a relatively big problem and perhaps we would understand… So when those in power break the rules and the public does not react irritably, regardless of what is the content of those rules, so they will do it, “says Kysela.

“The debate on the state of emergency is influenced by the fact that the government has managed to give the impression that we will all die without a state of emergency, because there are no equivalent equivalents, no equivalent substitutes, because many people quite logically do not want to die, so they want a state of emergency. it was declared against the will of the Chamber of Deputies, it seems completely insignificant to them. As long as we work with such a relationship with rules and institutions, and as long as we have people in public positions who don’t care, then we will see this result, “explains Kysela, a constitutional lawyer, about the general indifference to declaring an unconstitutional state of emergency.
