Japanese driver sues employer over 43 cents fine after minute delay

The Japanese news site Soranews24 writes that the driver had left a minute late due to a misunderstanding. He was supposed to ride an empty train to Okayama station, but he was waiting on the wrong platform.

Labor Inspectorate

By the time he realized this and rushed to the correct platform to relieve a fellow driver, two minutes had passed. This ultimately led to a one minute delay on departure and a minute on arrival.

The Japanese train company JR West therefore fined the man 85 yen (0.65 euros). The man then went to the labor inspectorate, after which his employer reduced the delay to 1 minute and the fine to 56 yen (0.43 euros).

The train driver still finds this unreasonable, because the delay had no consequences: after all, there was no one on the train. That’s why the man goes to court. He wants his fine to be compensated (0.43 euros), he wants to be paid for the minutes he worked outside working hours (0.10 euros) and he is demanding compensation for ‘mental torment’ (16,798.53 euros).

No work, no pay

The company said it has a “no work, no pay” principle, which was also true in this case. An employee will also be cut if he or she is late or does not show up, is the reasoning.

The Japanese timetable is known for its punctuality. Three years ago, a Japanese railway company apologized profusely for a train that departed 25 seconds early.
