Italy has issued an international arrest warrant for Shmuel Peleg, Eitan Biran’s grandfather

Eitan Biran’s grandfather gets into trouble: Italy has issued an international arrest warrant for Shmuel Peleg, the boy’s grandfather Eitan Biran, a survivor of the cable car accident, after it was accused of abducting him to Israel illegally, the Italian daily Corriere della Sera reported yesterday (Wednesday). According to the report, an arrest warrant was also issued for driver Gabriel Abutbul Alon, 50, who lives in Cyprus.

The newspaper quoted the Italian prosecutor as saying that “the grandfather planned how to get the child out of Italy once he realized he could no longer accept custody of him in the country.” The plaintiff added that Peleg, “in collaboration with Gabriel Alon, implemented a strategic and planned plan that allowed him to take the child with him to Israel.”

The prosecutor noted that “military and intelligence intelligence techniques” were used during the “operation”, adding that it was also a “suspicious” partnership. According to him, in the reconstruction made by the Italian investigators, the car in which the man and his grandson were traveling crossed the Italian-Swiss border in Chiasso without undergoing tests.

Peleg is accused of abducting 6-year-old Eitan from Italy about two months ago and transferring him to Israel illegally and without the consent of the boy’s aunt, Aya Biran, who is in custody in accordance with the Italian court’s decision.

Eitan was the only survivor of a cable car accident in May in which his parents, younger brother and a group of great-grandparents were killed. After the tragedy, his custody was imposed on his aunt by his father Aya Biran, who lived near Eitan’s family in the city of Fabia.

In September, as stated, Peleg transferred the child to Israel illegally and demanded ownership of him. Eitan’s family came to Israel and filed a complaint against the grandfather, and at the end of October the family court in Tel Aviv ruled that Eitan would stay in Italy with his aunt, and not move into the grandfather’s custody.

In addition, it was determined that when the grandfather came with the minor to Israel, the grandfather removed the minor from his usual place of residence, an unlawful removal within the meaning of the agreement, thereby violating the aunt’s custody rights over the minor.

The court also did not accept the grandfather’s claim that the aunt has no custody rights over the minor for the purposes of the Convention. And held that the rights granted to the aunt in the course of her appointment were sufficient to be regarded as having custody rights for the purposes of the Convention, which were infringed by the grandfather.

It should be noted that the arrest warrant comes after the Peleg family earlier this month appealed the decision of the Family Court, which ruled that it must return Eitan to Italy.
