The amendment to the Food Act from the workshop of the Ministry of Agriculture and Rural Development (MPRV) SR, which was approved by the government on Wednesday, will reduce the minimum fine for repeated breaches to 50,000 euros.

It will also allow the sale of food after the expiration date (DMT), but only after it has been offered to charity. The law should take effect on June 1, 2022.

Share of Slovak products

There is also a deletion of mandatory compliance with the share of agricultural products and foodstuffs produced in the Slovak Republic in paper or electronic promotion and marketing. However, the operator will be obliged to state the percentage of Slovak products in the total offer in the promotional leaflet.

According to the government-approved amendment, the operator will be able to sell food that has expired DMT only if it is safe, only in its own facilities, only to the final consumer, only if it is clearly separated from other food and for a maximum of 45 days after expiration of DMT.

The draft amendment to the law was submitted to two comment procedures. It was re-submitted to the second comment procedure, as 70 comments were made in the first comment procedure, of which 39 were substantive. Based on the dispute proceedings, after the first comment procedure, the discrepancies with the obligatory commenting entities were removed, but according to the results of the dispute proceedings, the draft law changed significantly.

For this reason, the bill was re-submitted for comment. 100 comments were made on the bill within the second inter-ministerial comment procedure, of which 61 were fundamental.
