Engie Romania will challenge in court the decision of the National Energy Regulatory Authority to fine the company with 800,000 lei for “alleged violations of legal provisions regarding natural gas offers and related contracts.”

The company claims that the notification of the final price increase, applicable starting with November 1, which was sent to customers who had not signed a contract for the supply of natural gas in a competitive manner until July 1, was made at a price of 175 lei / MWh (gas purchase price), while currently the purchase price is three times higher, which demonstrates that the proposed offer was made transparent, in good faith and taking into account the interest of customers.

The company draws the attention of decision makers with responsibilities in the energy sector that the market is going through an unprecedented crisis, both at European and local level. The natural gas suppliers were sanctioned with contravention fines in the total amount of 2,690,000 lei by the Energy Regulatory Authority (ANRE), which found the way in which the companies complied with the legal obligations.

ANRE has initiated control actions to verify the way in which the legal obligations regarding: the elaboration and publication of the standard offers for the supply of natural gas have been observed; the correct taking over of the information from the standard offers for the supply of natural gas in the supply contracts concluded as a result of the acceptance by the final customers of the respective offers; notifying the final customer of the intention to modify and / or complete the contractual conditions / clauses, as well as the increase of the price / tariff applied; providing transparent information to end customers.

Following the completion of the control actions, the natural gas suppliers were sanctioned with contravention fines in the total amount of 2,690,000 lei.

Engie Romania, E.ON Energie Romania and Restart Energy One were each sanctioned, with a fine of 800,000 lei, because in the publicly launched offers with a fixed price, valid for a certain period (6-12 calendar months), no mentioned that the supplier reserves the right to change the price offered during this period and thus did not fulfill their legal obligation to provide them, in a transparent manner, with clear information on the prices charged for the activity of providing gas prices, which they subsequently intended to change, starting with October and November 2021, through notifications sent to certain categories of customers.

ANRE ordered these suppliers to notify all final customers who have accepted commercial offers with a fixed price, the maintenance of the price of natural gas to which they undertook the offer, throughout its duration, and, as appropriate, the modification of gas supply contracts in agreement with the fixed price commercial offer.
