Deputy Chief Public Prosecutor of the Supreme Court of Appeals apologized for the murder of Hatice Kaçmaz

The law proposal to prevent violence against women and health workers was discussed in the Parliamentary Justice Committee the previous day. During the meetings, opposition lawmakers asked how the decision was made regarding the murder of Hatice Kaçmaz by Orhan Muris “not by design, but by emotional breakdown”. Bahattin Azizağaoğlu, Deputy Chief Public Prosecutor of the Supreme Court of Appeals, explained how the decision was made.

Stating that there was no unjust provocation discount in the case, Azizağaoğlu said, “The local court said ‘design’. Our First Department said, ‘There is no design’. Eight men at the Office of the Chief Prosecutor of the Supreme Court said, ‘There is design here’. And we appealed to the Penal General Assembly using the extraordinary objection. There, too, 14 high judges among our esteemed members said, ‘There is no draft’. Emphasizing that “If you ask my personal opinion, I think it is design too” Azizağaoğlu said, “There is nothing to do from now on. I have to say very apologetically, of course our hands are tied”.

During the negotiations of the proposal, there was also a discussion on the issue of unfair provocation discount. CHP Ankara Deputy Gamze Taşcıer criticized the lack of an article on this subject in the regulation and said, “In all cases, ‘What was he doing on the street at that hour? But he was wearing a red skirt, wearing lipstick, and a discount for provocation is applied, and for this reason, a lot of murderers who spent three or five years are roaming the streets right now.” AKP Istanbul Deputy Abdullah Güler also made the defense of “They are social media fabrications” on these words.
