Former Central Bohemian governor David Rath inherited the property from his father Ratmír legitimately and on the basis of a valid will. The court on Wednesday invalidly rejected his brother Michal’s lawsuit alleging that the will was invalid. None of the brothers appeared in court today. David Rath left prison in Brno last week, where he served half of his seven-year sentence for corruption.
The lawsuit concerned a last will written by Ratmir Rath in August 2014, two months before his death. According to the final motions of the two brothers read by the judge, the lawsuit arose immediately after their father suffered a heart attack, according to David mild, according to Michal severe. The plaintiff brother argued that his father was not in a position to write a will of his own free will, and that David was putting pressure on him.
The former politician refused, according to him the father was completely sane and wrote the will, by which he bequeathed all his property to him, due to disputes with his second son. David Rath had previously said that Michal should have threatened his father with reporting to the police and cursed at him, which his brother refused. The plaintiff’s lawyer did not file an appeal at the place of appeal on Wednesday and did not comment on the decision on behalf of the client.
Judge Irena Voštová said in the reasoning of the judgment that the court was based on an expert opinion, which was prepared by the police and which confirmed the authenticity of the will. “There was no indication that the testator was not a writer,” she said, adding that her father’s nurse’s statement had also confirmed this.
According to the judge, the testimony and the expert opinion of the cardiologist did not show that Ratmír Rath was out of his mind at the time of the heart attack and transport to the hospital. According to her, the plaintiff did not prove further allegations regarding the pressure on David’s father or the crimes of David in connection with the inheritance, and the police also postponed the criminal report that Michal filed against his brother. The judge further said that if new relevant facts emerged in further investigations in connection with the former Central Bohemian governor, this would be a reason to reopen the proceedings.
Ratmir Rath’s legacy should include eight million crowns, which the police confiscated during a house search of David Rath in 2012. At that time, he detained him for corruption, for which he was later convicted. The former governor has long claimed that his father saved the money.
David Rath was detained by police in May 2012 with a $ 7 million bribe in a wine box. The Prague High Court later pleaded guilty to influencing tenders for the reconstruction of Buštěhrad Castle in the Kladno region. In this so-called first branch of the case, Rath received a seven-year prison sentence. In the second branch of the case, the Regional Court in Prague illegally extended Rath’s sentence for another year. The Regional Court in Brno decided on his recent release in a closed session, the former governor returned to his home Hostivice and, according to his statement, does not want to return to politics.
