The complaining consumer ordered a product on December 22, but received it only two days later. Because it was a Saturday, delivery costs were charged. At the time, Coolblue stated on the product page ‘Ordered before 11:59 PM, free delivery tomorrow’.
The Advertising Code Committee finds that the webshop should have mentioned better that the free delivery on the next day sometimes failed. According to Coolblue, this became clear during the ordering process, as soon as customers had to choose a delivery date. But the Advertising Code Committee does not agree. “Because the claimed delivery time of one day can be of decisive importance to order a product from the advertiser.”
The Commission believes that the controversial sentence ‘could lead consumers to make a transactional decision that they would not have taken otherwise’. “For that reason, the statement is misleading and therefore unfair.”
Now it says ‘delivered tomorrow’
Coolblue has often been criticized for similar matters by the Advertising Code Committee. Apart from the negative attention, the decisions of the body have no further consequences. Coolbue now only mentions ‘delivered tomorrow’ on product pages – without the word ‘free’.
