Construction companies appeal Adif’s anti-corruption clauses after the sanction

The main construction companies in the country have submitted nearly twenty resources to the tenders promoted by Adif since last July 5 the National Commission of Markets and Competition (CNMC) fined Acciona, Dragados (ACS) 204 million euros ), FCC, Ferrovial, OHLA and Sacyr for altering the competitive process in tenders for more than 25 years. Adif sources explain to Europa Press that these appeals to the anti-corruption clauses presented by the employers’ association of the construction companies, the CNC, is what has motivated the suspension of a tender of 8 million euros to renew the high-speed line between Madrid and Seville in its section between the capital and Yeles (Toledo).

Specifically, the builders oppose the clauses that try to prevent the hiring of companies that carry out anti-competitive conduct and those that are in a situation of prohibition to contract, that is, those that have been sanctioned by not being able to present themselves to public tenders. As in most cases of projects financed by EuropeAdif wants to make sure not to hire companies with this type of behavior, since, in the event of any problem being found, the European Commission could ask Spain to return the money, with the consequent damage to public resources.

Adif has been including these clauses since 2019 and, until now, they had not been questioned by the construction companies. Nevertheless, the fine imposed by the CNMC in July has changed things, since this body forwarded the resolution to the Public Procurement Advisory Board to determine the duration and scope of the ban on contracting with these companies. Meanwhile, this tender is awaiting the decision of the Central Administrative Court of Contractual Resources (TACRC), for which Adif has been forced to extend the deadline for submitting offers.

The project continues

In any case, the renewal of the Madrid-Seville line, with a total of 470.5 kilometers in length, is underway with the contracting in recent months for the comprehensive renovation of three of the four sections that comprise the action: Yeles-Guadalmez (Ciudad Real), Guadalmez-Córdoba and Córdoba-Seville. Adif has already awarded works for this renovation plan for an amount of 490 million eurosof a total estimated investment of 650 million euros.

In addition to the contracts infrastructure renovationa (3 of 4 sections), has also contracted the renewal of signaling and telecommunications, which includes the installation of the ERTMS train command and control system. Likewise, the renovation of telecommunications and energy facilities has been contracted of the line and that of different elements of the railway structure such as sleepers, turnouts, track circuits or the line contact area (catenary).
