Constitutional Court. Lists by Chega, CDS and Us, Citizens violate parity law

The Constitutional Court today that the parties Chega, CDS-PP and Us, Citizens! present irregularities related to the parity law in the lists to the legislative ones by the constituency of Lisbon, giving two days to correct the situation.

The Constitution determines that the agents of the lists to the legislative ones have a period of two days to “correct the respective lists in accordance with the law of parity, “under penalty of full rejection of the same”, according to the judgment published this Friday. market.

The decision follows an appeal filed by the Alliance party considering that those three parties violated the parity law.

In the case of Chega, whose list is headed by the leader of the party, André Ventura, the assumption of a minimum representation of 40% of women is not respected.

Of 53 candidates from Chega por Lisboa, 21 are women (39.62%), therefore not reaching the “minimum injunction”, the Constitutional notes, recalling another ruling that concludes that this figure does not allow for rounding to reach the legally required minimum.

In the case of the Nos, Citizens! and of the CDS-PP, an article of the parity law is at stake which determines that no more than two candidates of the same sex can be placed consecutively.

In the CDS-PP list, headed by the party leader, Francisco Rodrigues dos Santos, this article is violated three times (three consecutive female names twice – positions 34th, 35th and 36th and 57th , 57th and 59th – and with four consecutive male names – from 40th to 43rd place).

We, Citizens! has four consecutive male names listed by the Lisbon constituency.
