Confiscation of the car is a measure that the police can use in certain situations. A 70-year-old man from Iași was sentenced to prison following an accident after drinking alcohol. He was also left without a vehicle.

The court ruled that, in this case, the confiscation of the car under Article 112 (1) (b) of the Criminal Code is a security measure. It is a blue Dacia Logan car.

In October 2020, under the influence of alcohol, the driver lost control of the car and hit another car, the Volkswagen brand. “The measure is proportional to the gravity of the deed, the value of the vehicle being not special either objectively, compared to make, model, age, state of wear, nor for the defendant,” the court’s motivation reads.

The driver, in a visible state of intoxication, was taken to a medical unit for biological sampling. The first test showed a result of 2.44 g / l pure blood alcohol and 2.28 g / l pure blood alcohol, respectively. According to the Criminal Code, these results amount to crimes.

The defendant was sentenced to one year in prison. His right to drive was suspended for a period of five years.

This is not the first time the car has been confiscated

The case of the man from Iași is not singular. On Saturday, September 13, the authorities ordered the confiscation of the car of a driver who was caught throwing garbage on the public domain, in sector 5 of the Capital. In that case, it was a dump truck used to transport waste. The person in question was sanctioned with a fine of 30,000 lei. Authorities also demanded that the culprits clean up the area within four days.

Until then, the police had resorted to the confiscation of vehicles only in cases where they had been pursued at the border or used in cases of smuggling.
