Building permits, Scia and landscape permits will be extended by 1 year

It is one of the objectives of the bill of conversion to the “Ukraine” Decree (DL 21/2022), which has been given the go-ahead, with confidence, by the Senate and is now being examined by the House.

Building permits, one year extension

Based on the Consolidated Building Act (Dpr 380/2001), the construction permit must indicate the deadline for the start of the works and the deadline for the completion of the works. The deadline for the start of the works cannot be more than one year from the issue of the title and that for the completion of the work cannot be more than three years from the beginning of the works.

The particular situation of rising prices and unavailability of construction materials has caused delays in construction sites. To respond to the concerns of insiders, the “Ukraine” Decree extends by one year the deadlines for the commencement and completion of the works indicated in the building permits issued or trained by December 31, 2022.

For the extension of building permits, Scia, landscape authorizations, environmental declarations and authorizations, there are two conditions:
– the terms must not have expired when the interested party communicates that he / she wishes to make use of the extension;
– at the time of communication by the interested party, the qualifications must not be in conflict with new approved urban planning instruments, plans or measures for the protection of cultural heritage or the landscape.

Development conventions, one year extension

The “Ukraine” Decree also extends by one year the terms of validity and those of the start and end of works of the subdivision conventions, of the similar agreements provided for by regional legislation and of the related implementation plans, as well as of the preparatory acts, formed up to December 31, 2022.

The extension is allowed provided that the conventions and agreements do not conflict with plans or measures for the protection of cultural heritage or the landscape.

Similarly to what is envisaged for qualifications, conventions and agreements already extended by previous regulations, including those to deal with the crisis caused by the pandemic, can also obtain the extension.
